雖然我不知道你家小叔對法拍屋熟不熟
但你可藉此順便熟一下

平常沒有在摸法拍市場的他,為什麼會突然看中這間房子?是因為有人介紹?
他了解房屋點交流程?如果遇到法拍蟑螂他有沒有能力解決?
先從這幾點,去了解看看小叔到底只是單純欠資金
還是根本連自己在買什麼都不知道
2.小叔能拿出來的錢有多少?
法拍屋在法院投標當天就要先繳兩成保證金,也就是120萬
你的小叔拿得出這筆錢嗎?還是說連這筆錢他們也想向你求助?
: 不是一般購屋時只付頭期款就可以了
其實都差不多
你平常買房子 也是向銀行貸一筆錢全額給賣家(建商或原屋主)
這時你的債主變銀行 抵押品是你買的房子
法拍屋是規定得標後七天內要繳清尾款 而先前講的保證金就像頭期款
除了「七天」這個必須要很快辦好的貸款期限
不然它只是手續更快的房屋買賣而已
大多數的法拍屋得標者,在得標當天下午就會拿去給銀行鑑價了
: 想當然耳... 他和女友所持有的現金應該有些差距
: 現在貸款無法及時拿到錢
3.應該有些差距?
究竟他們倆的現金是和保證金(120萬)有差距?還是和拍價(600萬↑)有差距
而如果是連保證金都湊不出來的情況
你就試想你若是銀行(沒錯,你借了錢就是擔任銀行的角色)
去評估一下他們的還款能力如何
若小叔和女友連120萬拿不出來,還想買600萬的房子
你認為該當如何?
是我的話會覺得他們連還房貸都有問題 當然是死都不會借
: 所以他們最近就開始籌錢 因為離投標的時間近了
: 婆婆就希望我們能多拿一點錢出來幫忙
: 我們在一個房價頗高的地方工作 新建案都要千萬了(含公設不到50坪的大樓)
: 雖然已經結婚 但還在物色房子
: 因為我們喜歡的買不起 買得起的以後要換屋可能條件也不好
: 對我們來說 這些積蓄很重要
: 縱使聽婆婆說 等小叔的貸款一下來就會還錢
怎麼不叫那個要借錢的自己來說
我從頭到尾沒看小叔對你們夫妻說一句話耶
: 但是我還是有很大的不安全感
: 畢竟錢離開了自己的手 就不是自己可以掌控的了
: (不是有人曾說過:錢還沒借出去的時候是別人求你借錢給他
: 錢借出去之後是你求別人人家也不見得會還你)
: 雖然錢出去了可能會再回來
: 但是有沒有什麼方法能避免花錢看清一個(家)人的情況發生呢?
: 不借是不可能的 我老公只是說沒辦法借到婆婆開的價碼就被罵到臭頭
: 被婆婆質疑我們亂花錢 (我們比小叔他們省多了)

好的方向:
1.就算湊到保證金去投標 也不見得標的到
若該屋是好物件(馬路旁透天厝)不少人都想去搶 甚至超過原拍價都有可能
到時候就是保證金退回 你們借出的錢繞了一圈又原封不動回到手中
2.部分銀行有專門承作法拍屋的貸款
(重點就是撥款快,但利率稍高,有些不足部分甚至會用個人信貸補足)
只要你小叔拿得出保證金 其實不會怕貸不到錢
所以你們可以承諾只支援「補足保證金」的部分
得標後的尾款問題 請他們自己去想辦法
3.趁此順便深入學習一些法拍屋知識
如果發現你小叔對法拍一知半解 連法拍屋知識都戰輸你
也可以他搞不清楚狀況為理由拒絕借錢
壞的方向
1.小叔推婆婆出來開口借錢 還開出目標價
顯然就是打了吃定你們夫妻的主意
如果你有以後自己買房也不會靠婆家的覺悟
(靠小叔?算了吧 到時候換你們開口時 他的錢不都是在繳他家的房貸嗎?)
自此不鳥他們也是可以的 買房靠自己就好
2.請小叔簽本票向你們借錢(請順便弄懂什麼叫本票,不是支票,也儘量不要寫成借據)
由於本票具有法律效力 若決定要借錢時務必謹守此線
只是雖然你們可以叫法院幫你們討錢
婆婆也會用家庭壓力叫你們不要討錢
所以這種方法有點半殘 只能說簽給自己心安的
3.若金額大到認為風險太大又因為婆婆的壓力無法推拒
那就要強力主張由你們夫妻出面標屋
標下來就是你們的房子 等小叔辦好貸款再從你們手中買去
就算小叔未來在錢上面裝死不付 至少你們夫妻手上還保有一間房子

其實以我和朋友的經驗 就算是好物件也會有一半的機率 等第二拍時再去標就好
畢竟法拍市場內好房子也不少 何必跟一些比你更有錢的人搶第一拍
只要等到第二拍 法院自動幫你把底價再打八折 有時一下就省了快百萬
標不到? 再多看看就有啦
